  1. General terms:

1.1. This agreement is binding on both parties, which regulates the rights and obligations of the buyer and the seller, purchase of goods and payment terms, delivery and return of goods, responsibilities of the parties and other provisions relating to the purchase and sale made from SIA "Baltic Cosmetics LV" ( hereinafter - the Seller).

1.2 The buyer agrees to the terms of this agreement by confirming it when placing an order in the online store or when registering in the online store.

1.3 The seller has the right to change the terms of the contract, taking into account the legal requirements. The buyer is informed about this through the online store or by e-mail.

 

  1. Buying/Selling:

2.1. The purchase/sale agreement is concluded when the customer:

2.1.1. Confirms the purchase in the online store (about which the Customer is informed by e-mail);

2.1.2. Confirm your order by phone, indicating the delivery address, first and last name, and sign the courier's document at the time of receipt (the delivery sheet, by electronically signing in the terminal or otherwise - depending on the courier's requirements);

 

  1. Rights and obligations of the buyer:

3.1. The buyer must pay for the goods in accordance with the payment terms.

3.2. The buyer undertakes to comply with these conditions, which are described in the online store and in the legal acts of the Republic of Latvia.

3.3. If the buyer does not fulfill his obligations, the Seller has the right to limit or terminate cooperation with the Buyer immediately and without prior warning.

 

  1. Rights and obligations of the seller:

4.1. The Seller has the right to cancel the Buyer's order if the Seller cannot contact the Buyer within 3 (three) working days, according to the contacts indicated by the Buyer.

4.2. The Seller undertakes to respect the Buyer's right to data privacy, which is related to the legislation of the Republic of Latvia.

4.3. If the Seller is unable to fulfill the Buyer's order (deliver the product in the specified time and/or deliver the product that the Buyer has ordered, then the Buyer has the right to return/refuse this order and the Seller must return the money to the buyer within 3 (three) working days, if The Buyer has already settled with the Seller, unless the Buyer and the Seller have agreed on a different delivery time or exchange the product for another.

 

  1. Product return:

5.1. The customer has the right to return the product within 14 (fourteen) days, taking into account the following rules:

5.1.1. Informing the Seller about this decision by submitting a written application to the Seller to the e-mail: info@farmavita.lv.

5.1.2. By delivering the product to SIA "Baltic Cosmetics LV" store - Avotu street 8, Riga, LV-1011;

5.1.3. When delivered, the product is in the original packaging, unused, in the same condition as it was purchased.

5.2. The Seller's obligations include returning the amount of the goods to the Buyer in the amount of 100%, transferring it within 30 (thirty) days to the bank account specified by the Buyer (in the application for the return of the goods), deducting the costs of delivery of the goods, if any. The seller has the right to refuse to return goods if the goods are damaged and/or have been used or misused.

 

  1. Delivery and payment terms

6.1. Delivery of orders is possible by picking up the product on site at the office of SIA "Baltic Cosmetics LV" at Avotu street 8, Riga, LV-1011 without additional charge or for a fee through couriers or parcel booths/lockers throughout Latvia.

6.2. The product will be delivered by courier within the next 3 working days.

6.3. Payment for the order is possible in cash on the spot in the store at Avotu Street 8, by bank transfer, by paying the received prepaid invoice or by making a credit card or automatic internet bank payment.

6.4. The buyer receives the original delivery note together with the ordered goods.

6.5. All disputes or disagreements, if they arise after the approval of this contract, the parties agree to resolve through negotiations. If it is not possible to resolve the creative disputes through negotiations, they will be referred to the Riga Arbitration Court.

 

  1. Warranty

7.1. If you changed your mind and decided to abandon the purchase, the Consumer Rights Protection Law of the Republic of Latvia (PTAL) and the governing Regulations of the Cabinet of Ministers No. 255 "Rules on Distance Contracts" (MK Regulations No. 255) state that the buyer has the right to withdraw from the contract within 14 calendar days time and return the product purchased in the online store back to the seller. Part 6 of Article 12 of the PTAL stipulates that when refusing a purchase in the case of a distance contract, "the consumer is responsible for maintaining the quality and safety of the product during the period of exercise of the right of withdrawal". We recommend keeping the product's original packaging so that when exercising the right of withdrawal in accordance with the terms of the Distance Agreement, the product is not externally mechanically damaged and not used. SIA "Baltic Cosmetics LV" reserves the right to refuse to accept a product that is damaged, used or not complete. 7.2. If technical problems have arisen during the use of the product, the service of the product will be performed in accordance with the norms of the Consumer Rights Protection Law of the Republic of Latvia. The product's service time is indicated in its description. Purchase documents are valid only if they correctly and clearly indicate: product model, serial number, date of sale. It is forbidden to make any changes in the purchase documents, delete or overwrite the data specified in them - in this case, the service documents will be declared invalid.

7.3. Claims received about the quality of the product will be dealt with in accordance with the norms of the Law on the Protection of Consumer Rights of the Republic of Latvia (PTAL), in accordance with the regulatory regulations of the Cabinet of Ministers no. 631. "Procedure in which a consumer's claim for a product or service that does not meet the terms of the contract" (MK Rules No. 631) is applied for and considered.

7.4. We remind you that PTAL norms do not apply to cases where the product is purchased by legal entities.
